Signifying what the industry trades call a “crackdown” and added “pressure” on unlicensed broadcasters, the FCC’s Enforcment Bureau has stepped up its issuance of warning-letters, primarily to pirate stations in New York and New Jersey. Of the 94 enforcement actions against unlicensed broadcasters this year, 52 of them have taken place in these two states. Enforcement activity also includes two Notices of Apparent Liability and seven Forfeiture Orders, for cases that originated in 2015-16. Overall, however, the pace of enforcement actions is running behind the totals of a year ago.
This is not necessarily an expansion of enforcement duties. NYC-based field agents especially are now doing what they call “follow-up investigations” – in a nutshell, agents now re-visit unlicensed stations they’ve already contacted. If they are still on the air, they issue yet another warning letter to the operator (or, in the case of one New Jersey-based pirate, to the owner of the property where the station is housed, who was not in on the first-round contact). “Follow-up investigations” typically occur within 1-3 months of initial contact with the offending station. Radio World revealed earlier this month that the acting chief of the Enforcement Bureau, Michael Carowitz, held a videoconference with members of the Bureau’s field-agent staff. The call revealed that the FCC’s downsizing of its enforcement resources has begun, with 11 field offices closed over the last several months (Anchorage, AK; Buffalo, NY; Detroit, MI; Houston, TX; Kansas City, MO; Norfolk, VA; Philadelphia, PA; San Diego, CA; Seattle, WA; Tampa, FL; and San Juan, PR) and 14 remaining open.
At present, that leaves just 34 field agents covering the entire country – this includes one of two roving “Tiger Teams” of agents organized to backstop the decimated staff in-residence. That’s almost a cut of half from the prior force of 60 that spanned the nation. A surprising uptick in the Enforcement Action Database for 2016: 201 total actions were logged last year, which is up from the prior two years. Furthermore, the frequency of threats of fines and actual fines against unlicensed broadcasters also rose: 9 NALs issued for a total of $155,000, and 5 forfeitures handed out for a total of $65,000. We haven’t seen numbers this large since 2014.
It gives some statistical credence to recently-former FCC Chair Tom Wheeler’s assertion that, despite the agency’s admittance that its license-enforcement protocol is effectively broken, it hasn’t ceded the field entirely. Though not by much, and certainly not along the lines of what we saw at the beginning of this decade. August was a busy month for FCC field agents, who conducted nearly three dozen enforcement actions against fewer than half as many stations. The state-leader this year so far is Florida – while New York still leads the all-time pack enforcement action-wise – and the FCC’s flexed its muscle in only seven states, compared to 10 in 2015.
Some of the cases are fairly curious, such as a $15,000 Notice of Apparent Liability issued against a Florida man who first started broadcasting without a license way back in 2013. One visit that year, followed by four visits last year (and a change in frequency), finally compelled the FCC to bring the threat of a fiscal penalty to bear.
Then there’s the case of an Alabama man who first hit the FCC’s radar in 2015; after being warned he voluntarily surrendered his transmitter via mail, only to get a new one and move to a new channel. When contacted again by the federales, he expressed the wish that he could be legal but no application windows for LPFMs are in the works, so his “hands were tied.” Not a good enough excuse to avoid a $15,000 NAL…but then again, it remains to be seen whether the FCC will formalize these as actual forfeitures, much less be able to collect on them. Last month the Pew Research Center published a short report on the growth of the LPFM radio service, following the conclusion of a 10-year legislative battle to expand it back to near the scope originally hoped by the FCC when it was first proposed in 1999-2000.
According to the report, since the passage of the Local Community Radio Act in 2011 and subequent filing windows for new LPFM construction permits, the number of licensed stations has nearly doubled, to more than 1,500 nationwide (including U.S territories and protectorates). Our mid-year update to the Enforcment Action Database shows absolutely no change in the FCC’s enforcement protocol regarding unlicensed broadcasting. Although the agency is running ahead of its enforcement action pace last year (70 to date, compared to 125 for all of 2015), it’s well off the highs seen late last decade. Fewer than three dozen unlicensed radio stations in just six states have had some form of contact with the FCC in 2016.
So far, Florida is the hottest spot for FCC activity with 25 actions to date; New Jersey and New York respectively round out the top three. That’s a surprising drop for the Empire State, which has not only topped the list for the last four years but whose Congressfolk and licensed broadcast constituency (along with their colleagues in New Jersey) have been clamoring for more anti-pirate policing.
Some of this political pressure may have been a factor in three monetary forfeitures issued to New Jersey pirates last month. Industry trades made great hay out of the $40,000 in total penalties — but all of these stem from cases that originated last year. When FCC Commisioner Mike O’Rielly spoke last week to the summer conference of the New York State Broadcasters Assocaiation, he made pirate radio the lead-off topic, sending a clear signal that the Commission is responding to recent Congressional pressure and industry lobbying on the issue. How that response will manifest itself is yet to be determined, but any viable effort will have to involve thinking outside the box about how to be better spectrum-cops.
“Far from being cute, insignificant, or even somehow useful in the broadcasting ecosystem,” said O’Rielly, “pirate radio represents a criminal attack on the integrity of our airwaves, at a time when spectrum has become more scarce and precious than ever before.” He compared unlicensed broadcasters to “poison ivy in a neglected garden” and estimated that nearly one-quarter of all pirates in the country reside in the New York area (data, please!). All hail Michael Marcus: one of the policy-fathers of wi-fi and Bluetooth (and a man with unimpeachable FCC bona-fides) has released a compendium of documents regarding plans for the FCC’s radical shrinking of its Enforcement Bureau.
The cache has three parts: a letter from FCC Chair Tom Wheeler to Greg Walden (R-OR), a member of the House’s Committee on Energy and Commerce; a memorandum to FCC field staff from Enforcement Bureau Chief Travis LeBlanc and FCC Managing Director Jon Wilkins; and a PowerPoint slide summary of the outside consultant’s work, conducted by Oceaneast Associates and Censeo Consulting Group.

A very interesting memorandum was leaked last week to two trade publications detailing a plan to severely reduce the FCC’s enforcement presence in the field. Presently, the agency’s Enforcement Bureau has two dozen field offices scattered throughout 17 states and Puerto Rico. However, not every field office is created equal: there are Regional Offices (many employees), District Offices (a handful of employees) and Resident Agent Offices (one or two people).
According to the American Radio Relay League, two-thirds of all FCC Enforcement Bureau offices would be closed, leaving just half the staff (33 people total) in the field. Just got the Enforcement Action Database caught up for the year, and the numbers show that FCC field activity is running at the lowest level it’s been since 2005. Just 173 enforcement actions to date, as opposed to ~260 at this time last year.
There was a similar dip in the years afer the FCC first proposed the creation of LPFM, and with LPFM’s second wave in the works it’s enticing to see a correlation, but this time around I’m more inclined to believe it has to do with changing political priorities regarding enforcement policy (pirates take a back seat to cell-phone jammers, for example) coupled with the effects of austerity on federal government services more broadly.
